Federal Registration - $1099

We need to do this as early as possible, but certain conditions need to exist first. These have to do with how you are using your mark, on what kind of business, and where. Let’s have a quick chat to see if you are ready for this critical step! (oh, and if you just need Washington State that’s $299 including the fees!)

  • Drafting and filing of the application with the USPTO for up to two classes - federal fees not included (federal filing now requires identity verification! This is one less thing you will have to do!).

  • Tracking your trademark application through its lifecycle.

  • Responding to any non-substantive office actions from the government.

  • Mailing your certificate to you when the registration is complete!

MANAGE

The Standard - $299/mo

You want to stay on top of your mark’s registration and potential problematic filings. Hearing from a USPTO examining attorney is helpful, but you want more. This service adds monitoring of ALL new federal registration applications in the USA that have the same or overlapping core elements to them, casting a much broader net than The Basics service. ALSO, this service adds 30 minutes of trademark attorney contact time per month so that you don’t have to worry about additional charges to answer your questions and keep your trademark on the right track!

The Basics - $99/mo

You know missing a required filing would be trouble, but you also want to know if someone tries to register a trademark the USPTO feels is too close to your own! Never miss a deadline and don’t miss an opportunity to enforce your trademark rights!

  • Notification of impending deadlines for the maintenance of your trademark.

  • Monthly email letting you know of any concerns a USPTO examining attorney may have raised that involves your trademark.

  • Free letter of protest to the USPTO for one conflict identified by an examining attorney per month (plus fees).

Registration Renewals - $249

Registrations are not forever. At regular intervals, starting between years five and six of the life of your federal registration, you will need to perform certain renewal activities. You may also get to declare your trademark INCONTESTABLE! For $249 plus fees per trademark for up to two classes you get:

  • Filing support for sections 8, 9, and 15 as needed for your mark.

  • Analysis of your use of your mark (you must use it as a trademark!).

  • Support for any non-substantive office actions from the USPTO.

US CBP Recordation - $299

I said that there are no trademark police. Not COMPLETELY true. If you have an existing federal trademark registration (or copyright registration) the US Customs and Border Protection Agency has the “authority to detain, seize, forfeit, and ultimately destroy“ infringing products entering the country, but only if this recordation is properly completed (beware: it will lapse if not renewed with your federal trademark registration!). You can have your precious registered trademark or copyright added to this watch list for $299 per registration plus recording fees. (NOTE: this must be renewed along with your federal registration)

Domain Name Watch - $99/mo

So many projects and businesses are exclusively online now. This drives the value of your internet real estate way up! Not just to you, but to others as well! I will watch the registrations in OVER 1,600 TOP LEVEL DOMAINS (TLDs) for not just the same domain, but anything confusingly similar (even internationalized domain names are covered!). You will get a monthly report on this activity giving you the earliest opportunity to manage any incursions to your precious virtual real estate. This vigilance has never been this easy!
